IMPORTANT: THIS SOFTWARE LICENSE AGREEMENT IS A LEGAL AGREEMENT BETWEEN YOU (EITHER AN INDIVIDUAL OR, IF PURCHASED OR OTHERWISE ACQUIRED BY OR FOR AN ENTITY, AN ENTITY) AND COMM SOLUTIONS. READ IT CAREFULLY BEFORE COMPLETING THE INSTALLATION PROCESS AND USING THE SOFTWARE. BY SELECTING THE DOWNLOAD OR INSTALL NOW BUTTON AND USING THE SOFTWARE, YOU ARE CONFIRMING YOUR ACCEPTANCE OF THE SOFTWARE AND AGREEING TO BECOME BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, THEN DO NOT INSTALL THE SOFTWARE.

# Definitions

1. "CS" means Comm Solutions.
2. "Software" means only the CS software.
3. "SUL" means CMM CMS Single User License.
4. "BFL" means CMM CMS Branding Free License.

# General

1. The 'Powered by Comm Solutions' and 'CmmCMS' Logo may not be removed or changed from the administration area website unless you have purchased the BFL.
2. With BFL must you rebrand Cmm CMS and provide it to your existing and future web design customers as your own CMS solution.
3. BFL doesn't include selling the CMS using the Cmm CMS brand.

# SUL Restrictions

1. You may not make or distribute copies of the Software.
2. You may not sell, rent, lease, or sublicense the Software.
3. You shall not use the Software to develop any software or other technology having the same primary function as the Software, including but not limited to using the Software in any development or test procedure that seeks to develop like software or other technology, or to determine if such software or other technology performs in a similar manner as the Software.
4. A License provides you with the right to use the Software to create only one website (one installation) for an unlimited period of time. For each installed instance of the Software, a separate license must be purchased.
5. In the event that you fail to comply with this License Agreement, be aware that you may lose your license and may face legal actions for Software Piracy.
6. A License can be transfered to another person provided that you pay a fee for this transfer. A license can be transfered 1 (one) time only. The fee for the license transfer can be changed without notice.

# CS Refunds

1. Refunds will only be given within the first 30 days of the purchase.
2. All refund requests are handled on a case-by-case basis.

We handle all refund requests on a case by case basis, and do not have a blanket refund policy. Being that this type of product cannot be returned, it comes down to us giving a customer their money back on a product that they cannot return to us. Since we have made it a lot harder for people to make fraudulent purchases using credit cards, we are finding many people purchasing the software, downloading it, then asking for a refund, while continuing to use the software. Sometimes we come to find out a month or so later, that the original purchase was fraudulent, and we suffer a chargeback fee, as well. It is unfortunate for those who are legitimately in need of a refund, because we have had to start turning down refund requests, except in rare circumstances. We have kept our prices as low as possible to allow people to purchase the software and use it. We sincerely apologize for the inconvenience, but this is our current policy.

# Disclaimer of Warranty

1. CS is not liable for the content of any website created with the Software.
2. The Software is sold "As Is". You must assume the entire risk of using the program.
3. ANY LIABILITY OF CS WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF PURCHASE PRICE.

# Rights to Update and Change the License Agreement

1. CS has the right to update and change the license agreement at any time without notice.
